H+ has continuously opposed the introduction of an AL cap throughout the political process and maintains this stance. Such a cap contradicts the goal of a fair and data-based tariff structure because it imposes blanket limits instead of specifically reviewing and developing tariff fundamentals. Meanwhile, there is now a legal mandate that must be implemented by the Federal Council. Within the approval framework for the 2026 tariff version, the Federal Council called upon the tariff partners to present their own implementation solution with the 2027 tariff version.
With this in mind, the H+ board has confirmed the submission of the tariff version 2027 of the overall outpatient tariff system, including the partnership solution for implementing the AL cap for approval by the Federal Council. Refusing the partnership implementation, as some have demanded, would increase the risk of the government enacting the measure unilaterally.
Errors need to be corrected and special circumstances of hospitals taken into account. For H+, it is essential that the unwanted instrument of a cap becomes obsolete as swiftly as possible. This requires a reliable data foundation and an adequate and regular update of the tariff structure. Where minute rates or tariffs no longer reflect the reality of care, swift examination and correction are required. If these corrections are implemented promptly, clearly, and permanently, H+ believes that the AL cap is unjustified and should be removed.
Additionally, the specific situation in emergency admissions as well as medical training and education have to be appropriately considered. In these areas, supply mandates, performance realities, supervision, documentation effort, and organizational conditions can deviate from standardized calculation logics.
"H+ clearly continues to oppose the AL cap. However, due to the existing legal mandate, we accept the responsibility and rely on the partnership solution. Under the given circumstances, it offers the best possibility to participate in the implementation, correct flawed minute rates, and appropriately consider special care situations," says Anne-Geneviève Bütikofer, Director of H+. "For H+, it is clear: Ambulant care cannot be secured with blanket caps, but only with a fair tariff structure and a reliable data foundation. Once tariff fundamentals are corrected, the AL cap becomes superfluous."
H+ will continue to bring forward the concerns of its members throughout the approval and implementation process. Practical, proportionate, and care-compatible implementation is essential.
